An Evansville man facing federal charges for anonymous threatening posts was in court Monday asking for those charges to be dismissed. Derrick Murray is in custody facing three counts of federal threats to kidnap or injure another person. Evansville police say Murray made threats in June on topix.com that put them and their families in danger. Murray's attorney Michael Keating says those alleged comments fall under the First Amendment right of Freedom of Speech, but Police Chief Billy Bolin says otherwise.  Police say online threats like "I got some new artillery I want to test on their thin <***> vests," came from Murray. Bolin says he supports his decision to raid a home thought to be linked to Murray back in June and he supports Murray's charges. Police linked Murray to other threats such as "Evansville will feel my pain." Murray's Attorney says his client plead not guilty for a reason. Both Keating and a federal attorney are making their plea, but a judge decided not to make a decision immediately. Murray's trial starts January 28th. No word on when the judge will decide if the charges should be dropped or not.
