A circuit judge says the parents of Ryan Owens may not pursue a claim against the Henderson County Board of Education. However, the suit will go forward against other defendants, including former Henderson High School Assistant Football Coach Tom Duffy Sr. and his son Tom "Duffer" Duffy Jr. Also named in that suit are athletic director Jerry Myzor, the Kentucky High School Athletic Association, school superintendent Thomas Richey and principal Bruce Swanson. The ruling says Ryans parents, Randy and Marla Owens, may seek compensation by filing an action through the state board of claims. Ryan Owens collapsed and died after football practice last July.
