City officials in Owensboro asked a judge to throw out a lawsuit that could stop a 263 acre development.
The city wants to create a tax increment finance district along Kentucky 54 to help pay for the project, which could include a new stadium, but last month about a dozen residents filed suit to stop the process.
Among other things, they claim the City failed to follow the states open door law in approving the package.
The City has fired back -- asking that the lawsuit be dismissed because none of the plaintiffs were personally injured by the action.
No hearing date has been set.
