Current and former miners say the Department of Natural Resources should hold onto all of the 4 million dollar bond money.
They say the area is still contaminated by the toxic waste dumped there more than 30 years ago.
Many claim it has caused rare cancers in miners and their families.
But the Department of Natural Resources Reclamation Division will decide whether the area is still in need of a cleanup and whether they should keep the money to do the job.
The Department is expected to make a decision in the next 30 days.
