The family of a killed miner is suing the company the man founded.
Thursday, Daniel McFaddens estate filed a $9.5 million suit against Frontier-Kemper Contractors.
The suit alleges the companys negligence resulted in the August 2007 deaths of McFadden and two other workers at a Gibson County mining project.
McFadden, Christopher Richardson and Jared Ashmore of Henderson fell 500 feet to their deaths while touring a service shaft the company was building at the mine site in Princeton.
The law firm representing the McFaddens states both the Federal Mine Safety and Health Administration and the State Bureau of Mines faulted Frontier-Kemper for causing the accident.
