James Garcia had agreed in February to plead guilty to reckless homicide in the 2011 death of Cameron Mullins in exchange for a 16-month sentence. Garcia was originally charged with manslaughter in the case.
A medical examination determined the boy died of a head injury, but he had several injuries to other areas of his body as well.
After the judge rejected the deal on Friday, Garcia's lawyers filed a motion asking the judge to recuse herself.
A hearing on that matter will be held next week.
